Terms of Use Agreement
Introduction
Welcome to the Enterprise Risk Management Application System (ERMAS)!
ERMAS is an internal system for use by authorized staff of the Public Procurement Commission (PPC). These Terms of Use ("Terms") govern your access and use of ERMAS and any information, text, links, graphics, or other materials within the System.
By accessing and using this System, you acknowledge that you are an authorized PPC employee or contractor with legitimate business need, and you agree to comply with these Terms and all applicable PPC policies and procedures.
User Accounts
ERMAS accounts are issued to authorized PPC staff for official business purposes only. Accounts are provisioned by the IT Department based on your role and departmental requirements.
You are responsible for safeguarding your password and for all activities conducted under your account. Do not share your login credentials with any other person, including colleagues or supervisors.
You must notify the IT Department immediately upon becoming aware of any breach of security or unauthorized use of your account.
Accounts may be suspended or terminated upon termination of employment or when access is no longer required for your role.
Content and Data
All information entered into ERMAS is official PPC business data and is subject to PPC's record keeping and information management policies. You are responsible for ensuring the accuracy and completeness of all data you enter.
Risk data, assessments, and related information in ERMAS are confidential and intended for internal PPC use only. Do not share or distribute this information outside the organization without proper authorization.
The PPC reserves the right to audit, modify, or remove any content entered into the System to ensure data integrity and compliance with organizational standards.
Intellectual Property Rights
The Public Procurement Commission owns all rights to the intellectual property and material contained in ERMAS. All rights are reserved. Your access to the System does not confer any ownership or rights to the underlying software, data, or materials.
You may not download, copy, or extract data from ERMAS for unauthorized purposes or for use outside PPC business operations. All risk data and system content are the property of the PPC and are subject to applicable information security and data protection policies.
Prohibited Activities
As an authorized user of ERMAS, you are prohibited from engaging in the following activities:
- sharing your login credentials with any other person;
- accessing or attempting to access data or functions outside your authorized role;
- using the System for any purpose other than official PPC business;
- using this System in any way that is, or may be damaging to this System;
- using the System in any way that impacts user access to this System;
- using this System contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the System, or any person or business entity;
- engaging in any data mining, data harvesting, data extracting or similar activity in relation to this System, or while using this System;
- using this System to engage in any advertising or marketing.
Access to certain areas of this System is restricted based on your role and responsibilities. The Public Procurement Commission may further restrict access by you to any areas of this System, at any time, in its sole and absolute discretion.
Support and Assistance
For technical support or assistance with ERMAS, please contact the IT Department via email at general@ppc.gov.jm or submit a support ticket through the internal help desk system.
Electronic Communications
Using ERMAS, sending emails, completing forms, and interacting via the System constitute electronic communications. You consent to receive electronic communications related to your use of the System. All agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communication be in writing, in accordance with the Electronic Transaction Act of Jamaica, 2006.
No Warranties
This System is provided "as is", with all faults, and the Public Procurement Commission makes no express or implied representations or warranties, of any kind related to this System or the materials contained on this System. Additionally, nothing contained on this System shall be construed as providing consult or advice to you.
Limitation of Liability
In no event shall the Public Procurement Commission, nor any of its officers, directors, employees, be liable to you for anything arising out of or in any way connected with your use of this System, whether such liability is under contract, tort or otherwise, and the Public Procurement Commission, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out or in any way related to your use of this System.
We give no warranties of any kind concerning the System or Content. In particular, we do not warrant that the System or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.
Although we will do our best to provide constant, uninterrupted access to the System, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.
Indemnification
You hereby indemnify to the fullest extent the Public Procurement Commission from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney's fees) arising out of or in any way related to your breach of any the provisions of the Terms.
Severability
If any provision of the Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.
Variation of Terms
The Public Procurement Commission is permitted to revise these Terms at any time as it sees fit, and by using this System you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this System.
Assignment
The Public Procurement Commission shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, you shall not be permitted to assign, transfer or subcontract any of your rights and/or obligations under these Terms.
Entire Agreement
These Terms, including any legal notices and disclaimers, policies or guidelines contained on this System, constitute the entire agreement between the Public Procurement Commission and you in relation to your use of this System.
Governing Law
These Terms will be governed by and construed in accordance with the laws of Jamaica, and you submit to the jurisdiction of Jamaica and its courts for the resolution of any dispute.
